I think the issue is not whether the confirming body can reject a candidate, its on what grounds. Currently, there is little wording in 2727 on the reasons. A reasonable intepretation is that the confirming body can reject a candidate for whatever reason it chooses. I believe Brian is arguing that this is the right intent. I think that Dave is asserting it shouldn't have a blank check, but should only be able to reject in more narrow circumstances. E.g., process failure within the nomcom. I think it would be good to clarify the wording here, so that should a confirming body decide to question the choice of a candidate or reject one, the nomcom understands on whether the grounds for the questioning/rejection are legitimate.
